1.1. This document ("Terms") governs the use of the Homenly.com website and services ("Service", "we", "our", "us").

1.2. By using the Service, you agree to these Terms and our Privacy Policy.

1.3. The Service is a platform for posting real estate listings and does not participate in transactions between users.

2. Definitions

2.1. User — any person who visits or uses the Service.  
2.2. Registered User — a user who has created an account on Homenly.com .    
2.3. Content — any information, text, photos, videos, and other materials posted on the Service.

3. Permitted Activities and Restrictions

3.1. For All Users:

• It is prohibited to violate intellectual property rights.

• It is prohibited to post false, misleading information.

• It is prohibited to use the Service for illegal activities.

3.2. For Private Individuals:

• May post listings for their own property.

• Are responsible for the accuracy of the information.

3.3. For Realtors and Agents:

• Are only permitted to list properties for which they have valid authorization.

• Must provide accurate contact information.

• PROHIBITED from using CREA trademarks (REALTOR®, MLS®) without explicit permission.

4. Listing Rules

4.1. Listings must contain:

• An accurate description of the property

• Real photographs

• A current price

• Truthful contact information

4.2. It is prohibited to post:

• Listings that infringe copyright

• Information containing discriminatory content

• Spam and advertising for third-party services

5. Intellectual Property

5.1. All rights to the Service and its functionality belong to Homenly.com .  

5.2. Users retain rights to their Content but grant us a license to use it for the purposes of operating the Service.

6. Disclaimer of Liability

6.1. Homenly.com is not responsible for:

• The content of posted listings

• The results of transactions between users

• The accuracy of information provided by users

6.2. The Service is provided "as is". We do not guarantee uninterrupted operation.

7. Legal Disclaimers

7.1. Homenly.com is an independent platform and is not affiliated with:

• The Canadian Real Estate Association (CREA)

• The MLS® System

• The REALTOR.ca website

7.2. The terms REALTOR® and MLS® are registered trademarks of CREA.

8. Termination of Access

8.1. We reserve the right to terminate or restrict access to the Service for any user who violates these Terms.

9. Changes to the Terms

9.1. We reserve the right to change these Terms. We will notify you of changes through our Service.

10. User Responsibility

10.1. The user is fully responsible for:

• The accuracy of posted information

• Compliance with real estate laws

• The consequences of transactions conducted through the Service
